Halle Berry seeks sole custody of son with Olivier Martinez

Halle Berry is seeking sole legal custody of the son she shares with ex-husband Olivier Martinez, claiming his “turbulent” behavior has negatively impacted the 10-year-old.

The Oscar winner, 58, says son Maceo has serious behavioral and learning issues that his father refuses to address, according to new legal documents obtained by TMZ.

The filing, which points to the effect Martinez’s “detrimental behavior” has had on Maceo, comes nearly a year after the couple settled their contentious divorce last August — almost eight years after their 2015 split.

The “Union” star claims in the filing that their son is falling behind in his studies, in no small part because his father puts an emphasis on soccer over school. She also says Maceo returns to her angry and combative after spending longer periods of time with Martinez.

Berry has implored the judge to give her full custody so she can single-handedly make decisions on Maceo’s education and therapy.

Berry says she spent hundreds of thousands of dollars trying to come to an agreement with Martinez behind closed doors, but now feels she has no other choice but to file the public legal docs, per TMZ.

Berry and the César Award-winning French actor were married for two years before they filed for divorce in October 2015, citing irreconcilable differences. Despite reports that they later tabled the proceedings and were trying to work things out, the former spouses were declared legally single at the end of 2016.

In 2020, news broke that Berry intended to represent herself in the long-running divorce case.

As part of settling the proceedings last August, Berry agreed to pay $8,000 per month in child support and said she would pay for Maceo’s private school tuition, supplies and any extracurricular activities. The agreement also noted a family counseling plan to help mend the difficult co-parenting situation.

Prior to Martinez, Berry was in a five-year relationship with Canadian model Gabriel Aubry, with whom she shares teenage daughter Nahla.

She was also married to former Yankee left fielder David Justice from 1993-1997, as well as R&B singer Eric Benét from 2001-2005.
