Concrete pump truck driver in court Monday for deadly Hays CISD bus crash

BASTROP COUNTY, Texas (KXAN) — A court hearing in Bastrop County is scheduled to take place on Monday for the concrete pump truck driver involved in a Hays CISD bus crash back in March.

Two people were killed in that crash, 5-year-old, Ulises Rodriguez Montoya, who was on the bus. The other person killed was 33-year-old Ryan Wallace the driver of the car behind the bus.

The bus was carrying a total of 44 Tom Green Elementary pre-K students and 11 adults who were returning from a field trip at a zoo in Bastrop County when the crash occurred on State Highway 21 near Caldwell Road on March 22.

Jerry Hernandez, 42, the concrete pump truck driver told investigators he had smoked marijuana the night before the crash, and also admitted to smoking cocaine later on that night, according to an arrest affidavit.

Hays CISD said that the bus involved in the crash did not have seatbelts. Hays CISD Superintendent Dr. Eric Wright said back in March that the school district would be “accelerating” the process for replacing buses without seat belts.

This will be the first court hearing to take place since the March 22 incident.
