Hayward man turns himself in for fatal hit and run

FREMONT – A Hayward driver who authorities say was intoxicated turned himself in to Fremont Police for the alleged fatal hit and run of an unidentified jogger last week, according to a news release.

Police said that on Sunday night the suspect, a 29-year-old Hayward man, was allegedly under the influence of drugs and alcohol when he hit a pedestrian who was jogging northbound near Mission Boulevard and Nursery Avenue. Authorities found the jogger dead at the scene sometime around 8:40 p.m., police said.

Police say the suspect allegedly, Brian Gutierrez, fled the scene on foot before police contacted him via phone. Police said he later decided to turn himself into authorities.

“Drug and alcohol impairment, as well as speed, are believed to be factors in this collision,” police said.

Police arrested Gutierrez at 9:59 p.m. in Hayward, according to jail records. He was booked into Santa Rita Jail Monday morning on suspicion of hit and run and driving under the influence of alcohol, causing bodily injury.

His arraignment is scheduled for Wednesday morning at 9 a.m. in Department 702. He is being held in lieu of a $125,000 bail.

This is Fremont’s fifth traffic fatality this year, police said.
